The juvenile dependency court system is administered by two different entities. The Superior Court of California juvenile dependency departments is part of every county Superior Court system in California. This system is part of the judicial branch of the local government. The county social workers have different names from county to county. In Los Angeles, they are referred to as the department of children and family services DCFS. In most parts of the state, they are referred to as child protective services cps. Cases generally start with an investigation by the county social workers which could, but not always involve the local or federal police agencies. A juvenile dependency investigation sometimes leads to a criminal investigation, which is separate and apart from the social worker's investigation. Recently a client told me that she spoke to the social worker because the social worker said something to the effect if you don’t talk to me and answer my questions it’s going to make you look bad in front of the judge and this might be true but it might not be however I can assure you if you talk to the social worker most times you are going to look bad because you don’t what you should say nor what you shouldn’t say so the simple advice is don’t say anything until you can speak to a lawyer From a lawyer's perspective if you don’t talk to the social worker he/ she can’t gather information and evidence against you most likely the worker didn’t observe how an injury occurred, so your words become the main evidence against you. My general advice based on almost 31 years of experience does not talk to a social worker without consulting an attorney! And as you know doubt seen on TV and the movies don’t talk to a police officer without consulting an attorney I know this is simple advice but I see all too many times parents and relatives I want to violate this advice because the social worker acted as if he/she were trying to assist them or outright intimidate them please don’t be fooled.
