 CPS INVESTIGATIVE

Unless extenuating circumstances warrant an extension, the CPS has 30 days to conclude an investigation. Within 24 hours, a CPS investigation must begin and typically involves:

• Interviews with the alleged child victim(s), the caretaker(s) of the child, the alleged perpetrator(s), face-to - face.
• Viewing home for the family.
• Examination of all relevant documentation, such as police reports, criminal records , medical reports, school reports, case files for CPS, etc.
• Neighbors, colleagues, relatives or specialists who have had contact with the family will be interviewed.
• An evaluation of the protection of the infant.
• An estimation of the potential risk of violence and/or neglect by the child.
• An analysis of the interests and abilities of the family.

During the inquiry, the CPS investigator will take into account the following factors:

• Will the accusations have alternate explanations?
• What are the dynamics and family situations of the family?
• Who is filing the complaint?
• Is there corroborating proof? (For instance, statements from witnesses, findings during a home visit, etc.)
• Should a child's medical test take place?
• Does the baby have an injury? If it is so:

1. What is the injury explanation?
2. Is the explanation achievable?
3. Where are the accidents located?
4. At various stages of recovery, is there more than one injury?

• What is the home 's condition? (Cleanliness, safety risks, etc., for example.)
• What is the baby's condition? (For instance, proper clothing, cleanliness, etc.)
• Are the basic needs of the child being met?
• Does sufficient monitoring exist?
• Are the caretakers manipulating the child emotionally / mentally?

CPS must assess, on the basis of the analysis of the aforementioned factors, whether there is a preponderance of proof of child abuse or neglect. Preponderance of evidence indicates evidence of greater or more compelling weight than evidence provided in contrast to it; a 51 percent probability that violence or neglect has taken place.
